This thesis seeks to respond this question that whether a Muslim has any advantage over an atheist in Islamic Jurisprudence or they are equal. We want to answer this question to clarify the propensity to Islam from juristic aspect for Muslims in a way to help them maintain their situation in the world. So, in the first chapter terms like: Islam, Kufr, Shirk, and Ahli – Kitab are defined as well as the verse based on which the jurisprudence scholars (Foghaha) have established their interpretation to allocate an advantage for a Muslim over an atheist. In the second chapter, juristic reasons for allocating an advantage for a Muslim over an atheist throughout religious rules are extracted and surveyed based on holy Quran, Islamic traditions and narrations. This chapter contains several sections including: uncleanness and cleanness of atheist, his being prohibited of approaching Masjid –Ul- Haram and Masjid –Un-Nabi even passing through them, being Imam for congregated prayers, recanting, donating, paying Khoms, hunting and immolating. In the third chapter juristic reasons for allocating an advantage for a Muslim over an atheist in trades (in general meaning) are surveyed. This chapter contains several sections too, including: Vaghf upon atheist, his oath taking, possessing a foundling, being not permitted to adopt a Muslim child or marry a Muslim adult girl, being buried in Muslims, graveyard, being heir to a Muslim, trading with a Muslim and not being equivalent to get married with a Muslim. In the fourth chapter juristic reasons for allocating an advantage for a Muslim over an atheist in judgment are surveyed. This chapter contains several sections too, including: capital punishment, atonement, testimony and judgment. In the fourth chapter juristic reasons for allocating an advantage for a Muslim over an atheist in political and social areas are surveyed that includes: relation between an atheist and a Muslim, governance and dominance of an atheist, prohibition of a Muslim, s simulating to and kindness toward an atheist.
