the constitution is the cornerstone of the rule of law and is superior to other norms and because of this importance and to create a balance, the idea of legislative powers emerged. this means given freedom to intervene an official in his powers of her legal authority without being dependent on the will of another authority. this is done by selecting and comparing solutions and alternatives offered within the framework of constitutional controls, this is not an absolute power because in the latter case it leads to deviation and departure from the rules defined in the constitution. thus, the oversight role of the judiciary constitution on behalf of the federal supreme court was highlighted the establishment of those two stages, the first was repealed by the law on government administration for the transitional period in 2004 and the second by the promulgation of the amended constitution of the republic of Iraq in 2005, which is in accordance with the supervision of the constitution and interpretation of its provisions. It was therefore necessary to discuss in the previous bylaws and the mechanism of the formation of the court, which granted the court supervisory jurisdiction and protected its decisions from appeal. and there is a need for research to clarify the supreme judicial authorities in Iraq who they are made of, and which law they have invoked. and as an institution overseeing the legislature powers. Where the legislature has acquired this authority or competence from the people (citizens) as a source of power the supervisory role of this court is to hear the claims of the aggrieved persons, whether natural or legal persons in its decisions, it targets the public interest and its decisions are final. I took a descriptive and analytical approach. the dissertation was divided into three chapters: the first chapter was concepts and generalities, the second chapter covers the scope of the Iraqi supreme court’s oversight of the legislature, third chapter regulates the oversight of the federal supreme court in Iraq by the legislature.
