The presence of the administrative judiciary’s control over administrative issues and the management’s actions towards employees are considered important safeguards for employees and their freedoms because of the adoption of the legitimacy of the state of law and justice. In Iraq and Jordan, which is able to resolve disputes that arise between the employee and the administration, and that litigation is an authentic constitutional law and a pillar of the basic freedoms required by the legal nature of the state and the basis of any sound democratic government. As a main route and a primary guarantee for the protection and exercise of public rights and freedoms, especially in practice, in addition to theoretical data, the procedures for regulating disputes are of great importance in various judicial systems, whether civil, administrative or criminal, as these procedures represent an important step in arriving at the truth and adjudicating it. The importance of the research lies in shedding light on the litigation procedures before the Staff Judiciary Court, and the administrative litigation procedures require accuracy in study and comprehension. And it reached a set of conclusions. It is necessary for that body to form a legal framework that ensures the proper performance of its functions and to be adequately prepared for this presentation, and to always ensure that its qualification is at the level commensurate with the job entrusted to it.
