RIGHTS FROM JURISPRUDENTIAL AND ETHICAL PERSPECTIVES

Citizenship rights is one of the most fundamental concepts that have been commonplace among thinkers and philosophers since the appearance of society and government. In Iran, these rights have been given special attention from constitutional period. This thesis investigates citizenship rights from jurisprudential and ethical perspectives through descriptive-analytical method. The goal of this research is to justify citizenship rights from moral and jurisprudential perspectives first, and then to identify instances of these rights. Some existing theories about the nature of citizenship and citizenship rights are reviewed and the relationship between citizenship rights and human rights are investigated. The moral discussion includes the ethical foundations of citizenship rights according to virtue ethics, Deontologism and Utilitarianism as well as Mu’tazilites and the Ash’arites. In the jurisprudential discussion we have tried to find some reasons from the Qurʾān, traditions and jurisprudential maxims.
