This thesis, entitled “The rights of foreign workers in international law and constitutional legislation in Iraq and Lebanon: comparative study”, is based on a methodological (comparative) approach. The study is based on a comparative analytical legal approach, which is based on the collection and compilation of information on the rights of foreign workers based on international law and the laws of the Iraqi and Lebanese republics, and through the provisions on their regulation of the Labor Code, The Residence Act and the instructions on the practice of foreign workers in Iraq and Lebanon, indicating the legal position of the said laws on the regulation of migrant workers.
The research dealt with general concepts in the rights of foreign workers, and then dealt with labor laws in human and religious thought, as well as the religious influence in the drafting of laws and rights, the regulation of the conditions of workers, their guarantee, care and punishment. Regional international instruments on the right to work and all political and public rights with regard to foreign workers in both countries were highlighted. This study dealt with the identification of migrant workers in Iraq and the conditions to be taken into account in the process of the regulatory and legal recruitment of foreign workers entering Iraq, as well as the legal regulation of foreign workers entering Lebanon. In addition, the international legal regulation of workers ‘ rights has been compared with the labor laws in Iraq and Lebanon, with the evaluation of the Iraqi and Lebanese labor laws in terms of advantages, strength and weakness, and thus manifested many of the benefits and effects resulting from this study at the scientific, theoretical and applied level, as the benefit of searching for foreign labor and their Hence, after coming up with the general conclusion, the research reached a number of conclusions and recommendations, the most important of which: Administrative and legal regulation in dealing with foreign workers in Iraq. There is a special law, known as the “alien’s residence law”, which consists of 48 legal articles that regulate the conditions of foreigners residing on Iraqi territory. The same is the case in the Lebanese Republic, which has special legal and administrative procedures and mechanisms in dealing with foreign workers and is subject to prior supervision by the General Directorate of Public Security. The legal regulation of foreign workers in both countries is thus comparable to international law, conventions and treaties.
