Philosophical Rereading of the Criterion of Human dignity and comparing it with Jurisprodential Viewpoint

“Human” is the base of humanities. The most basic query in the humanities and law foundation is “human dignity” and it is based on human definition and identification. Ignorance in human definition can prevent our achievement to results can be general and globalized. In our opinion, there aren’t any comprehensive set of criteria for human definition biologically. Thus, human rights and the other features in human sciences, could not be attributed to human biology.

It is tried to explore at the first, contraction or abstraction of dignity. The author believes that abstraction is impossible because dignity is a value and implicates moral orders. Such issues couldn`t be abstracted from external beings. Then, dignity contraction needs contractor or an origin for contraction. Self-contract values are invalid and unconscious external beings are incapable for it. We need a stable contractor to justify stability and native sense of contract dignity. That stable, conscious, senior to human and human seniority donor is God.

In the dignity criterion, we seek on those differences that make essential difference with other organisms and could be the basis for dignity. This convey scientists to wisdom based human identity. Author thinks wisdom in different degrees is common in animals and it is an important device that makes power, not value! But free discretion is specific and options can give value according to their values. Options are right and wrong or nice and bad.

Looking at authenticity and majority of right and nice options, author vote on dignity authenticity in all humans and misery must be proved. Hence dignity proof difficulty changes to misery. Separation of dignity existence and proof can explain religious and jurisprudent opinions in the existence discussions and can close to liberal opinions in the proof discussions. Author opinion may be efficient in two perspectives approximation.
