The legal representative or the legal employee represents his ministry or department in the civil proceedings, whether it is a claimant or a defendant or a third person for clarification or a third person complementing the litigation, and criminal trials in which the legal employee often represents the public right as a complainant or a civil claimant or Witness or clarification of a specific case. Or represent the objected or the defendant in the Court of Employees Judiciary and the Court of Administrative Judiciary, as well as the Federal Supreme Court, before which jurists may not plead except for those who were in the rank of legal advisor older or above bylaw of the Federal Supreme Court No. 1 of 2005, which defined him with the term “manager” in Article 20 of the order. Also, one of the duties of the legal employee is to express the legal opinion on the issues presented to him that are problematic in his department or the subject of disagreement between the departments of the department. The legal employee, with his duties, contributes greatly to building the state, and there are jurists who have brought large funds to the Iraqi treasury by returning stolen money, lands and others, and he is nothing but a simple employee under the authority of his direct management, which calls for opening a large field for blackmailing the employee and his threat by the administration itself to influence his procedures and recommendations, whether in investigative committees, lawsuits or legal opinion, which makes the most important element in legal work lapsed, which is impartiality and independence. Therefore, this study came to clarify the legal organization of the legal employee and the responsibility that falls on him and to try to shed light on the shortcomings in the Iraqi and Arab legislation that pertain to the legal employee.
