The issue of the legal organization of the municipality is a very important topic, and interest in it has increased after the political transition in Iraq in 2003 and the desire of the Iraqi legislator to pay attention to the administrative aspect and to maximize local revenues achieved by the correct legal organization of the municipality, and because it is very close to the people, the municipality plays an important and effective function In governance mechanisms and internal power formations, it also plays an important role in local development, development and centralization. Local conditions, desires, needs, and aspirations are best understood when they are close to citizens. This helps it to mobilize energies and resources, and helps it achieve national policies as a practical reality that meets the aspirations of citizens. On the other hand, it provides a solution to these issues and ways that suit the needs of this society. When it comes to humanitarian issues, only municipal institutions can confirm the unity of society from By taking into account local public opinion and involving individuals in finding answers and providing the best services through its tools, and that governments and local administrations are built on the basis of citizen participation, and this is the driving force behind it. In this research, we have observed the role of the municipality and its legal organization in comparative law and the legal context in Iraq. Using a comparative study, we hope to highlight many patterns and degrees of development on the path of local administrations and decentralization, as well as emphasizing the fact that this development is endless. We also hope to learn about the various development trends in this field and try to benefit from them with regard to Iraq, emphasizing the basic fact that each country has its own circumstances and systems derived from these circumstances. As the research problem is represented in the shortcomings of the legal regulation of municipal institutions and its oldness in Iraq.
