Punishment is a decision or judgment of the competent authority to deprive the civil employee of the material or moral benefits of the job or to terminate the work relationship between him and the institution due to a positive or negative wrongful act and job requests through certain procedures and guarantees must be followed to deter the injured employee and warn others of injury in order to maintain on the public utility system and achieve its objectives. The laws regulating the public function have given great importance to the public employee, and the reason for this is that the success of the administration in carrying out its duties towards the public depends on the efficiency of its employees and their sense of responsibility and the need to achieve the public interest. If we wanted to know the extent of the legality of the actions issued by him, we would refer to the Penal Code, which operates with the rule (there is no crime and no punishment without a text). Violating the duties of a public office or violating public order under the supervision of the administrative judiciary. The topic of the research is gaining importance because it is closely related to many principles of administrative procedures, especially those related to the impact of penal sanctions on public employment compared to Iraq and Algeria. In addition, the research on the issue of penal sanctions on public office and in light of the relevant applicable texts is another meaning presented in amending the amendments to these texts in order to ensure a successful legislative treatment of the issue in Iraq and Algeria. The aim of the research lies in shedding light on the impact of penal sanctions on the public job, a comparative study between Iraq and Algeria. The main research question is what is the impact of penal sanctions on the public service, a comparative study between Iraq and Algeria? In order to answer this problem, we have prepared this research for the imposition of penal sanctions that target the public interest and take into account considerations of the good conduct and continuity of public facilities. The possibility of limiting administrative violations and the impossibility of applying the principle (no crime without a text), but the specific penalties and violations are left to the assessments of the investigative committee that is formed according to the legal article of the comparative country.
