The Effect of Administrative Investigation on Criminal Investigation A Comparative Study Between Iraq and Egypt

Considering the development of the political and economic lifestyle in iraq and its impact on the legislative and judicial situation, including the prevalence of certain crimes, the most obvious of which are the crimes of financial and administrative corruption and waste of public funds, Which are often committed by employees, administrative research is of particular importance. it is necessary to activate the mechanism and research tools for such crimes, this process starts from the administrative investigation in a specific department. also, differences in jurisprudential opinions, judicial execution and official instructions issued to relevant courts regarding the role of administrative investigation in the criminal field and its impact on the current investigation process by investigative courts and competent courts are important where we address in our study the impact of the administrative investigation on the criminal investigation in iraqi law and egyptian law, which is considered one of the important studies in the aspect of administrative law in iraqi law and egyptian law. the subject of the research refers to the impact on the investigation, that is, the impact of the administrative investigation on the criminal investigation and the procedures that appear in both iraqi and egyptian laws. the federal court of cassation and the supreme administrative court, the decisions of the courts of appeal as discriminatory, the advisory opinion of the state council, the supreme administrative courts in egypt and the egyptian state council, analyzing and comparing them with some texts to find out the agreement and the difference between them and the legislative texts, in order to show how the investigation with the public employee is carried out in iraqi and egyptian law, explaining the competent authority in the verification procedures we seek to achieve the important results of the investigation, including the public servant’s fulfillment of his duties in his public office and the practice of administrative activities with confidence, ensuring the proper functioning and orderliness of the public facility.
