Extracted Jurisprudential Principles from Biography of Prophet Mohammad’s Foreign Policy

Systematic religious orders in the foreign policy are of the most important issues that the Islamic society should consider it in religious government based on the dynamic Islamic jurisprudence. Given the overall performance and behavior of the Prophet Mohammad (AS) in foreign policy, It should be said that he has depicted school of international relations and in fact principles of international laws and humanitarian principles by placid firm principles through language of his deeds and fulfilled the needs of the foreign policy of the Islamic system in the position of government administration. According to the importance of Prophet Mohammad’s biography, being accepted of both sects, System of Tafaghoh like an institution of science, of alive and dynamic knowledge, can extract a series of rules and principles, from the biography of his foreign policy, to set legal strategies needed in foreign policy and international relations. Taking look at the biography of Prophet Mohammad’s foreign policy- the most successful governor in the field of building nation and state and rapprochement with other nations of his time- two majors of rules and principles were extracted. A major part of his foreign policy was diplomacy regarded as his first strategy from the beginning to the end of his mission and important rules as invitation, expedience, fulfillment of international obligations, diplomatic immunity, peace and the rule of Etezal were derived from it. The second part of his foreign policy was jihad and defense policy as a secondary solution in case of dysfunctional politics of diplomacy and, being necessary. Two jurisprudential principles are extracted from Prophet Mohammad’s jihad policy. The first is about his behaviors in order to control war and lack of human tragedy that jurisprudential principles of combat controllers are extracted such as non-use of force, necessity of calling before the jihad, regarding separation in hostilities, banning the use of weapons of mass destruction and the principle of non suffering.
