There are two views on the relationship between Muslims with the infidels in general and the non-book infidels in particular and the covenant between them between the Shiite and Sunni commentators and jurists. The popular view that has been put forward by earlier commentators and jurisprudents is that it is obligatory with the infidels of the Book to accept Islam or pay jizya, and with the non-book infidels until the acceptance of Islam or to be killed, and to conclude a peace or leave treaty. Fighting is not permitted except in cases of necessity. Another theory that has been put forward by later Shi’ite commentators and jurisprudents is that jihad is only with infidels who enter into war with Muslims, are seditionists, or violate their covenant with Muslims. It is permissible, but it is not permissible for infidels who are not violent and seditious and in breach of the covenant and who want peace and a peaceful life with the Muslims, and they can be made peace treaties and disputes as long as they make their covenants with the Muslims. Do not violate, Muslims must abide by their covenant. Of the two views presented, the latter is more in line with Islamic teachings and doctrines. Therefore, in this research, while presenting the first view and their arguments, this view and the arguments presented by its followers are criticized and then with various arguments including Quranic verses, traditions and the way of the Prophet of Islam and Muslims, the view Recent has been proven. One of the achievements of this thesis, which is a descriptive-analytical one, is that besides presenting the viewpoints of Islamic scholars on the permissibility of peace with non-religious polytheists and infidels and presenting a correct viewpoint on this subject, some other issues, such as proving the authenticity of peace The principle of war and strife as well as the importance of peace and the many blessings of this work have been addressed to individuals and to the Islamic and international community.
