This study dealt with a topic of the most important topics that the principle was an already prevalent for the state’s mistakes, but the modern trend believes that the organization of state responsibility for judges’ mistakes represents guarantees for retaining mistakes in which the jurisdiction can be located, This has prompted the legislator in modern countries to reconsider that rule, so that the state’s responsibility for the work of the judiciary is the basis. In this regard, the study aims to present the legislative exceptions contained in the Iraq principle of non-state responsibility for the work of the judicial authority and the practical application of the theory of state responsibility for the work of the judicial authority, for the purpose of the judicial analysis based on the analysis of the existing analysis. By analyzing the text Based on the foregoing, we will divide the topic of our thesis, which is the introduction and three chapters so that we deal with the preliminary investigations and is divided into two chapters, in the first the concepts and the second topic of colleges, and the second chapter, which includes the interrogation of the state and the scope of its responsibilities. The responsibility of the state to reconsider criminal judgments, and the second topic is the responsibility of the state in the event of a dispute with the judiciary. As for the third chapter, the responsibility of the state because of personal mistakes in the judiciary, where it includes three investigations of the state’s mistakes, the first cases are the limits of the judiciary’s responsibility for cases Legislation, and the third topic, the state’s responsibility for judicial police actions, and the study ended with a conclusion that included the most important results and recommendations.
