The types of endowment funds that play an important and privileged role in the history of Islamic civilization have a special nature, those who track endowment books and specialized writings in it, whether in the field of law and sharia rules. Which requires it or the legal field and how to document and defend it, but even the history of its inception and development. From the jurisprudential point of view, he finds a clear difference between the jurists of Islamic religions in defining it and even in its rulings on its necessity or absence, and it is permissible and denial, and it also finds it. Their differences in the elements and conditions and even its types are clear, but in the legal dimension, especially in Iraqi law, the Iraqi shari’ah has not defined waqf, but has reached its three divisions, which are derived from one of them. Islamic religions and the definition of each section separately, with the difference that legal scholars were not unaware of the definition of waqf and the expression of its rules. The Iraqi legislature also paid close attention to endowment funds and their organization, as well as their investment through the enactment of special laws for it. Therefore, this study was conducted to explain the concept of endowment and its types and legal and legal provisions, as well as the concept and methods of endowment investment and its types in order to maintain the desired benefit from it. It is also necessary to state the provisions of the investment and its legal basis and in order to maintain the source of the endowment and increase its growth and benefit through investment or transactions, investment monitoring or any transaction. Which is in the endowment and is in accordance with the Sharia and the law and is not contrary to the existing condition (if any) and also the realization of the purpose of which is in the interest of the absentees. In this study, I addressed the issue of controlling the investment of public endowment funds in Iraq, and chose the Shiite endowment as a model for this study to show its importance.
