The presents study has tackled a comparative study of family rights in the Holy Qur’an and the international declaration of human rights. It aims at investigating family rights which are approved by the Holy Qur’an and the international declaration of human rights and explicating the aspects of similarities and differences between them. The significance of the current study lies in the fact that the family is considered as the basic constituent of society through the missions of both mother and father. The wisdom behind having the family is to coexist with that mission. The current study has followed the comparative, descriptive-analytic approach.
The present study comprises four chapters. Chapter one is introductory. It is subdivided into three sections. The first section sheds light on the topic itself; the second section deals with definitions of key words; while the third one is dedicated to investigating the parts and characteristics of human rights in the Holy Qur’an and the international declaration of human rights. Chapter two pinpoints the rights of the members of family; whereas chapter three tackles the family rights in the international declaration of human rights. It consists of two sections: section one deals with the characteristics of these rights, while section two traces the rights of the family. The last chapter includes two topics, the first topic discussed the methodology and buildings of family rights in Al- Quran Al- Kareem and the international announcement of human rights and the second topic includes the agreements and differences between them.
The current study rounds up with a number of conclusions, the most important of which is that the Holy Qur’an has the priority in the endorsement of family rights which are characterized by comprehensiveness, depth, originality, and balance; the Holy Qur’an is characterized by a number of characteristics and features which the international declaration of human rights lacks, including that the concept of family in the Holy Qur’an is different from that which is found in the international declaration of human rights. According to the Qur’anic concept, a family is a social bond built on human relationship as a result of legal marriage represented by a contract between a man and a woman. The study has also found certain common points in the field of family rights in both the Holy Qur’an and the international declaration of human rights.
Finally, the present study has recommended rejecting items found in the international declaration of human rights which do not conform with Qur’anic texts and not to act on them.
