The punishment of the offender has been accepted by human societies and has been with him since the beginning of human civilization. One of the most important issues is tools and kind of performance of the punishment, in the other words, is kind of punishment legal or illegal?!
The importance of this issue becomes apparent when recently some Islamist groups, called Islam and under the pretext of following the Companions, attempt to burn enemies alive and document this act to the first guid of Shiites, Imam Ali (as) claimed to have set fire to some of the clerics, including Abdullah bin Saba
The study, using a descriptive-analytical method, examined the punishment of ahraq and human punishment and concluded that it was based on the Holy Qur’an, jurisprudence, narration and history in the Islamic religion. It has no value and it is dedicated to God on the Day of Resurrection. It is also in contradiction with the general principles governing crime in the religion of Islam and the principle of human dignity, which is one of these principles.
