Jurisprudential Study of Media Representation of Women’s Crimes According to Ayatollah Khamenei’s Point of View

In today’s societies crime occurrence is undeniable, the legislature imposes penalties encountering with crimes in order to secure society through legal action. There are dissimilarities between men and women in committing a crime; Women commit less crime than men, the type and purpose of the crime committed by women is also different. We face the disadvantages and also the information capacities of media and the development of communication while their expansion. Jurisprudence and law; along with other sciences, help the legislator in order to establish peace among the members of the society by enacting laws so that issuance of a sentence for the offender is for the same purpose. Criminals, according to the crime they have committed, must be punished justly and they must compensate if they have violated the rights of individuals or society. According to jurisprudential documents and principles, the punishment of Tash-hir (media representation) has been considered for some crimes as the main or complementary punishment. Since Islam considers the sanctity of a believer as honorable as the sanctity of his life and property, so that offender’s Tash-hir must have a high necessity, which is permitted by the Shari’a. In the past, Tash-hir was carried out by methods such as trolling the offender around the city, but today, the media helps a lot and this issue has been facilitated therefore the offender has become popular in a wide range of society. Tash-hir of the offender is possible with a court order. The responsibility of the media is very significant, media is not allowed to act arbitrarily in any way. Women’s crimes have special differences among the crimes for some reasons. If a female criminal is going to be Tash-hir, this thoughtfulness will increase, most jurists did not issue permits for women’s Tash-hir for crimes committed. From the jurisprudential point of view of Ayatollah Khamenei, criminal’s Tash-hir has its limitations and where it has been permitted its due to expedient expediency.
