Judiciary is one of the most important sensitive centers in the Islamic State and it is obligatory on the ruler of the Islamic society to establish it and the judge is obliged to implement its rulings. Judging in the Islamic system means ruling and arbitrating based on the standards of Islam. In such a way that it resolves the conflict and fight between people and transforms their abnormality and disorder into the norm and order, therefore, the judge must have special conditions and characteristics, such as: knowledge and awareness, alertness, justice and piety. so That any threats and temptations do not divert him from the direct path of truth, and judge according to all aspects and conditions of time and place. In this research, the conditions of the judge are investigated from the perspective of Imami jurisprudence and Shafi’i religion as two Islamic religions, And has explained the conditions that the two jurisprudences have for the listed judge and has stated their similarities and differences. In this context, these two religions share some issues and differ from each other in others.
