Public Service is critical to States’ lives, through which the State can meet public needs employment opportunities for qualified persons, combating unemployment and through public employment; By relying on employees, the State can achieve development in the country by making the necessary plans in this regard and therefore the State cannot carry out its duties without relying on a wide network of competent officials who meet the requirements established by the legislator for the occupancy of the public office; Its importance and disadvantage to the lives and needs of the public. This research, entitled <Public Service and its conditions a comparison study between Iraqi law and Sudanese law>. It begins with the definition of a public official and a public official in positive law in general, especially in Iraqi law and Sudanese law. Hence, the conditions for the assumption of public office are set out. The research discussed the rights of the employee in Iraqi law in comparison with Sudanese law. These rights consist of the financial and administrative rights established and confirmed by the provisions of the law. It then touches on the moral duties associated with the principle of good faith, namely the failure to disclose the employee’s secrets. It stresses the need to differentiate the law from the professional secret and the experience acquired by the employee. The study recommended that the Iraqi and Sudanese legislators should form a committee comprising legal and technical elements outside the administrative body for the posts to be appointed. The Department’s role is limited to merely expressing its desire and need for vacant posts. The Committee shall be referred to that Committee with the necessary powers for the purpose of recruiting for those posts and shall have binding decisions.
