The Legal System of the Integrity Commission and its Relationship with other Regulatory Agencies in Iraq

The Integrity Commission is one of the independent bodies in Iraq. It was established by virtue of Order 55 issued in 2004, which is repealed, and the statutory law attached to it, and it was confirmed in Article (103) of the Constitution of the Republic of Iraq for the year 2005 in force. This commission was granted various competencies and powers, so we had to explain the legal system for it and whether it is independent or not. Through previous studies that were raised about the nature of the integrity commission, we found that it is one of the independent bodies. It has several preventive measures carried out by the commission, according to the powers granted by law. It also has the right to see how work is going in state institutions and to verify and address corruption. We have followed the analytical approach by analyzing the legal texts contained in Iraqi laws that dealt with the Legislative Council or the commission. Integrity is a legal and logical analysis to come up with a legal outcome with positive results in our study The problematic of our research was also to know the legal mechanisms followed by the Integrity Commission in detecting corruption crimes. Has it succeeded in reducing this phenomenon in Iraq and knowing whether everyone is within its jurisdiction or are there specific crimes only? And do the investigative powers granted to it in crimes within its jurisdiction overlap with the jurisdiction of the investigation bodies affiliated to the Supreme Judicial Council? Is there cooperation in its work with other regulator agencies or not ?We have reached several results in the research, the most important of which is that the Integrity Commission as an independent body in the fight against corruption in Iraq is newly established. The Integrity Commission has judicial jurisdiction, due to the presence of an investigative judge in it. As for the purpose of establishing the Commission, it is to prevent corruption of all kinds to achieve transparency and impartiality.
