The comparative constitutional systems that adopted oversight on the constitutionality of laws have varied in the matter of organizing this oversight and in the authority concerned with it. The Supreme Constitutional Court is like Iraq, and if the constitution is the protector of the general rights and freedoms of individuals and groups by providing for these rights and freedoms, then monitoring the constitutionality of laws is an important means and a great guarantee for the protection of rights and freedoms The importance of the study is highlighted through the role played by reciprocal supervision between the functions of the legislative authority and its role in achieving mutual balance and protecting the rights of public freedoms in the state and clarifying the correct foundations and principles upon which the regulations are based in the relationship between the functions themselves, as well as falling on the role of the Council of Ministers in issuing regulations through policy review The legislative framework on which the numerous regulations issued and their evaluation are carried out through studying the role and competence of the Council of Ministers in issuing the regulations. The constitution to ensure the extent to which laws conform to its provisions. Judicial oversight means the establishment of a judicial body entrusted with the task of monitoring the constitutionality of laws, which is a subsequent oversight for the issuance of laws. From the proposals of these studies, we suggest to the Iraqi, Iranian and Algerian legislators to expand the oversight functions of the legislative authority to include all government bodies from the President of the Republic to the Court Judicial.
