This dissertation deals one of the important issues (election monitoring is a comparative study of Iraqi law and Iranian law) because elections are an urgent necessity in all countries of the world that have risen from their people civilly. The expansion of elections, which knocks on the doors of rulers and the people, and sometimes even upsets the balance of power, is one of the factors that causes the election process to change and from the election stage to the monitoring stage, and this change ensures the health and impartiality of the election. So that the people see their rights guaranteed and are filled with confidence that their choice is the one who, when he takes power, leads them away from political auctions and authoritarian disputes. The importance of this topic lies in the fact that it sheds light on the legitimacy of the elections and allowing citizens to express their freedom and how to protect it, because it represents the core of the democratic process. The main purpose of the research is to analyze the elections and get acquainted with the details of how they are held in order to achieve the progress that we are seeking in the neutrality of the elections. What is new in this dissertation is a comparison between the Iraqi election law and the Iranian election law. In this research, we relied on inductive and analytical methods, so our goal in this research was achieved. This study consists of three chapters and a conclusion, that in the first chapter the concepts and generalities are stated, in the second chapter duties of monitoring the elections in Iraq and Iran, legal organization of elections, the impact of Islamic Sharia’ and also the impact of some constitutional texts on elections have been examined. The third chapter deals with the role of election monitoring and ensuring its impartiality, and how to monitor and submit an appeal to the holding and results of the election. This research has reached several results, the most important of which are: Election monitoring forms a regular framework for maintaining the election process in accordance with what is legally provided for it, which through it, violations and cases of breach of the law that occur can be observed, and the mistakes and defects of the election set can be resolved with administrative, professional and legal reforms. The influence of political parties on the state and its organizations and their entry into the elections leads to confusion in its management and weakens its purposeful efforts. Therefore, parties should enter into this field in accordance with the disciplinary rules established by law, and decisively contact with its violation and as a deterrent ensures the health and impartiality of the elections.
