Judicial Oversight on the Legitimacy of the Economic Decisions, a Comparing Study between Iraq and Iran

Judicial oversight on economic decisions is considered as one of the most important assurances to rise the performance of economic decisions, which is the most important principle and the basis that carried out by the stat, the essential purpose of this oversight is for arising the economical standard, and working for highlighting the importance of the economic decisions and showing that this matter has a big importance in people’s life, considered as important as taking care of Iraqi and Iranian people’s life.

  This project has a strong connection to the present time, and that is because it has solutions for some problems that are facing people in economic status. In this project, we depend on inductive methods for comparing the legal provisions between Iraq and Iran.

  This study has dealt with the general concepts of judicial oversight and declared the Islamic point of view about this matter, specifically the judiciary. This study has revealed the historical path of judicial oversight in Iraqi and Iranian’s law, and addressed the goals, types and benefits of the economic decisions.At the end of this study has concluded that judicial oversight over economic decisions is a real assurance for the personal rights and benefits. Judicial oversight is one of the most important types of oversight in the country, because the judiciary is a qualified institution to protect the legitimacy principle from futility and
