The title of this study is “The Legal Protection of the Female Employee in the Iraqi Administrative Law (Comparative Study of Iraq – Lebanon)” The public, and the responsibility that it entails during the performance of its duties within the scope of administrative and criminal law, as well as the corresponding disciplinary and penal guarantees granted to protect the employee at every stage of accountability even after the imposition of the penalty on her. In order to achieve the public interest, the state needs the assistance of female public officials who can offer their efforts and expertise for the public interest. The main question in our study is this: What is the legal protection of an employee in the Iraqi administrative law, a comparative study of Iraq and Lebanon? The legal protection of the employee is one of the important issues dealt with by the Iraqi and Lebanese administrative organization, especially since the state departments are mixed with male and female employees. The thesis aims to reveal the most important points on which the manifestations of discrimination against employed women in Iraq and Lebanon focused, if these manifestations stem from the cultural and customary heritage, customs and traditions rooted in the mind of the Arab man since ancient times and inherited from a long time ago, generation after generation, but will gradually fade due to technology and the development taking place in Society. In order to address this issue, we will rely on the analytical approach, to analyze a number of legal texts related to disciplinary and penal guarantees, by studying the disciplinary laws in Lebanon and Iraq, and the laws related to criminal procedure in Lebanon and Iraq, and we will rely on judicial decisions issued by the Iraqi judiciary . Among the most important results obtained by the study are: The Iraqi law did not allow the employee referred to the investigation to seek the assistance of a lawyer to have a defender stand by her side, but this silence does not mean prevention, as the use of a lawyer falls within the defense rights established for the employee, and the administration cannot deny it.
