The legal protection of the employee’s pension rights lies through a special legislation that guarantees their rights and the provision of livelihoods for them and their families in both Iran and Iraq, where protection emerges necessary in terms of providing the necessary needs of the retiree and his family in order to face life’s difficulties and what the world is going through in an exceptional circumstance called ( Covid 19) and the big problem facing elderly retirees who are more vulnerable to this deadly epidemic, as it requires the competent authorities to develop quick treatments for this oppressed group, as the study sought to demonstrate the legal protection of the employee’s retirement rights between Iraqi and Iranian law through a statement of the legal system’s keenness in each From Iran and Iraq, especially the retirement system, to cover all the rights of retirees and seek to guarantee their retirement rights, but a large group of employees who benefit from this system are ignorant of these rights and the majority of them do not know retirement except that it is a sum of money received by the employee or employee upon reaching old age or inability to work, in addition to highlighting and clarifying the retirement system and unveiling the rules that govern it, with the development and proposal of treatments for the Iraqi legislator In order to guarantee the rights of retirees, and to clarify the legal basis for the public employee’s enjoyment of pension rights in Iraq and Iran, as well as to explain the reasons for deprivation of pension rights and how to challenge them in Iraq and Iran.
The descriptive, analytical and comparative approach was used to analyze and shed light on the legal protection of employee pension rights, a comparative study between Iraqi and Iranian law.
The study came out with several results that are useful in the field of legal research, including the agreement of Iraqi law with Iranian law in some mandatory and obligatory referrals according to the conditions and controls specific to each law
