The issue of rights and freedoms occupies a distinguished position in the constitutional and criminal fields alike, because of what it constitutes a direct violation of the individual, and the extent to which the state can provide the necessary protection for him, so that the status of states is directly related to the extent to which they protect the rights and freedoms of individuals. Hence, we pose the following question, which is what are the constitutional rights and freedoms of the accused in the Iraqi and Egyptian constitution?, which the research seeks to answer, by clarifying the concept of right and freedom in general, and then addressing the rights and freedoms of the accused, because he may be the weaker party in some cases In the criminal case, as society may consider the accused as a person who does not deserve respect and does not enjoy any right or freedom because he is accused of committing a particular crime, he may be far from committing it.. Thus, the importance of the research is that it is considered among the constitutional studies, because it deals with the research of many people who may have been wronged or were the result of malicious lawsuits, which may lead to the violation of their natural rights and freedoms. In addition, it represents a priority because the issue of preserving rights and freedoms is a priority in the legal state. In addition to a statement explaining and detailing the rights and freedoms of the accused that he enjoys under the constitutional texts, in the Iraqi constitution of 2005 and the Egyptian constitution of 2014, and conducting a comparative study between them, and proving that the accused enjoys some constitutional rights and freedoms, such as his right to defend himself or his right to speed The conduct of the investigative procedures or his physical and psychological freedom.
