Legal Regulation for the Establishment of Administrative Contracts and How to Invalidate them A: Comparative Study between Iraqi Lebanese and Egyptian law

The state takes into consideration the representative of the group, and the state is entrusted with the public affairs, as it works to achieve the public interest, by all the different legal methods available to it, such as the issuance of legislation and decisions unilaterally, or the establishment of contracts with others.For this reason, the administrative body tends to establish contracts with others for the purpose of managing the public facility. In this study, we dealt with the concept of the administrative contract in legislation and jurisprudence, as well as the origin of these contracts in the comparative countries. Then we dealt with the types of administrative contracts, the pillars of the administrative contract and criteria for distinguishing it, and we also dealt with the legal organization for the establishment of administrative contracts and the foundations that The contracting process is based on it and we dealt with the administrative steps for establishing administrative contracts, and then we discussed how to invalidate such contracts, and we clarified the definition of invalidity and its types, and what are the causes of invalidity. The complexity and lengthy procedures, and all of this affects the functioning of the public utility, so it was necessary to explain its nullity issues in the comparative state in an accurate manner in order to reach solutions and in order to develop legislation or issue new legislation that is appropriate with the objectives of the administrative body in order to manage and manage the public facility and that Legal offices in comparative countries need research and comparative analysis between the laws of the country In this study, we reached many conclusions and recommendations.
