The effect of the principle of regularity in the functioning of the public utility in the administrative position in Iraqi law

Under this principle, the inevitability of public utilities regularly continued as long as it provides services for citizens are essential to satisfy the general needs can not be in any way be dispensed with, that the principle of continuity of public utility requires the public authority to secure and respect for public facilities, both in the public, where employees prevent their strike laws If the contract is forfeited, the contract is terminated by force, or in the field of administrative contracts where the public authority permits itself to be terminated if the contract is forfeited. The importance of this research lies in two aspects, the first of which is to identify the types of effects of the principle of regular functioning of public utilities in the administrative function. The second is its importance from the importance of the subject being treated, the regularity of the functioning of public utilities ensuring the direction of the work of the administrative function to achieve its goal of maintaining public order, and the resulting protection of public rights and freedoms. In my study, I followed this analytical approach by referring to scientific references from public and private literature, research, periodicals and scientific seminars. The current study is an attempt to present an analytical legal study by reading the texts of internal laws. The judiciary’s innovation of modern successful mechanisms, such as the theory of emergency conditions, in order to protect the public facility and its regularity on the one hand, and to protect its clients on the other hand, came in order to preserve the principle of continuity of the public facility, as well as in order to provide quality and quality services.
