Exploitation of the Position for Private Purposes in the Iraqi Administrative Law

Government employment is one of the most comprehensive issues of administrative law because it is closely related to administrative and public service institutions and organizations, and one of the crimes related to poor job performance is a crime that an employee may commit by engaging in government employment. Corruption and employment are among the crimes of abuse of public office, which are important problems in the international and domestic arena and are one of the most important crimes that undermine trust between the citizen and the government and sow the seeds of doubt in the justice and transparency of the government. The commission of crimes of abuse of office by an employee leads to the end of government cooperation with the employee. One of the responsibilities of a government job is to fulfill the public interest of society, and the responsibility lies with the person who is formally and government-employed for a job called real service.Avoidance of some prohibited behaviors or ignoring it while performing the duty or violating the rules due to performing the duties, or violating the rules and bills while performing the duty, or failing to perform the duties are examples of this crime and mean a negative score. In the future, it is the individual’s job, and as a result of committing them, he will be sentenced to the main punishments, which may be followed by additional and consequential punishments. Through this research, we achieved some important points. 1- Rules of procedure are important matters referred to in the administration of public service affairs and are based on a legal basis and organize the work of government employees and their relationship with the government. 2- One of the reasons for the termination of the employment relationship is the commission of criminal offenses that lead to damage to the public interest and public service, one of these offenses is the abuse of public office. 3- The administrative judge has the power to revoke, modify or approve the sentence of an employee accused of committing crimes of professional misconduct.
