The law in general prevails in the principle of legality, that is, the submission of the state, rulers and ruled, to the rule of law, and the legitimate guarantee of the rights and constitutional freedoms of individuals, for this principle is the just judiciary, and its necessary procedures, especially in the administrative field. In its true sense. That this principle does not achieve the desired goal, except in the submission of all decisions and actions issued by the executive authority, as the source of the greatest danger to the freedom of the individual, to the supervision of the judiciary; To verify its agreement with the text and spirit of the law, and then to ensure that it does not deviate from its provisions, and to decide to cancel it, or to compensate for its harmful effects on individuals, or both. In order to achieve this, it is necessary to identify these procedures in Iraqi law, and to indicate the adequacy of the current organization of the Iraqi administrative judiciary in this regard; Due to the modernity of this organization, compared to other countries, and also to shed light on the rules of jurisdiction, its characteristics, elements, and its role in the legal organization, and how to specialize in conducting the work of the administrative judiciary, and how responsibilities are determined to achieve speed in the completion of all work, and to indicate the degrees of non-jurisdiction, and is it possible to take them In the Iraqi legal system, as well as a statement of the importance of the administrative judiciary in Iraq, and the necessity of upgrading the rulings issued by it in this regard, similar to the provisions of the administrative judiciary in the comparative countries.
In order to achieve this, we will divide this study into three chapters, preceded by an introduction and followed by a conclusion
