The Impact and Role of Cultural Human Rights in the Iraqi and Iranian Constitutions

This study dealt with the cultural human rights stipulated in the Iraqi and Iranian constitutions, and in the interest of the Iraqi and Iranian legislators about the importance of those rights and freedoms.

 This study examined global standards that guarantee the recognition of these rights when governments fail to protect them. The United Nations, which works to maintain international peace and security, has enacted most of the international laws that recognize human rights and ensure their maintenance, and also examined the statement of the importance of cultural human rights followed in constitutions and law. The Iraqi and Iranian people know the rights of the citizen, including the Iraqi constitution and the Iranian constitution.

 Does the Iraqi constitution take into account in its texts all the principles related to cultural human rights?  Which are stipulated by all international conventions?  Does the Iranian constitution also take into account cultural human rights in its texts?  In order to answer this problem, the researcher followed the comparative descriptive analytical approach in order to reach results. The research was addressed in three chapters. Then this study reached several conclusions and recommendations that respecting these cultural rights today is an international obligation of the state before the international community and a measure of the legitimacy of governance in it. In this way, it is necessary to fulfill the obligations related to the respect of states for these rights, to educate and spread them, as well as to spread the Islamic culture that supports the principles of human rights, and to emphasize the violation of some social and clan customs and traditions to the principles of Islam.
