The permission to imitate a live mujtahid is a matter being consensus between Islamic sects, but there are controversies regarding imitation of the dead mujtahid among them that the present thesis, titled imitation of the dead mujtahid, with reference to their arguments tries to take the random opinions of the “Islamic sects” of the Imamiyya and Sunnis to illustrate the dynamics of Islamic jurisprudence. There are many sayings about permission or non-permission to imitate between religious scholars. In Imamiyya there are two sayings generally; first one is Akhbari that believes in permission and Osuliyya that believes in non- permission. There are two sayings generally among Sunnis. Some of the early Mujtahids regard imitation as Haram. In contrast, some of the early jurists, such as the great jurisprudents of Hanafi, Mohammad Hassan Shaybani, believed in the license of imitation. This paper seeks to illustrate the issues of Islamic jurisprudence with the descriptive-analytical approach in the affair with the proofs of the jurisprudents of Islamic sects in some cases, along with their arguments on most issues. To achieve this, by referring to the library method, by referring to the sources and primary evidence in all matters and about the initial imitation of the dead mujtahid, it is to be noted that there are occasional and definitive issues.
