This research attempts to examine the relationship between dimensions of temperament and personality factors with marital conflicts, with regards to explain lack of related regulation in Iran. Statistical population is compatible, incompatible, and in divorce couples. The sample size is 384 people (192 couples) were selected by using cluster random sampling and snowball technique. We have used two questionnaires to measure the claim; NEO and Marital Conflicts. The findings released that there is no significant relationship between marital conflicts and dimensions of temperament – warm, moderate and cold – except for the reduction of effective communication. There was no significant relationship between these three temperaments and the five factors of personality, except for the extroversion factor. There was a significant relationship, however, between dimensions of marital conflicts and moderate and cold temperaments in reducing sex, increasing emotional reactions, increasing relationships with relatives, increasing relationship with spouse’s relatives and decreasing the effective relationship as well as there was a meaningful relationship between these tree temperaments and personality factors other than extraversion in the four categories, namely, Neuroticism, Extraversion, Openness to experience, Agreeableness and Conscientiousness. Finally, the results showed that the four factors of extraversion, Openness to experience, Agreeableness and Conscientiousness have a meaningful relationship with the dimensions of marital conflicts. The theoretical findings also indicated that despite the emphasis in the upstream documentation on the consolidation of the family foundation, there are no proper regulations for a thorough examination of the mental health of individuals before marriage. Therefore, with regard to the influence of personality and temperaments on the spouses’ relationships and the reduction of marital conflicts, it seems necessary to establish some rulings and intervention of legislature to review some regulation, for instance article 1040 of Civil Law. The intervention of legislature is for emphasizing on recognition of parties before marriage.
